- DATA PROTECTION ACT
1.1 Bespoke uses user data for the purposes of the services that it provides. Users providing personal data consent to the use of that data by Bespoke for the purpose of effecting introductions between Clients and Tutors, for billing and fee collecting purposes, to enable Bespoke to contact the user and to inform users of agency and education-related newsletters.
1.2 The Tutor consents to Bespoke and the Client holding and processing data relating to them for legal, personnel, administrative and management purposes and in particular to the processing of any “sensitive personal data” as defined in the Data Protection Act 1998 relating to them including, as appropriate:
i. information about their physical or mental health or condition to monitor sick leave and take decisions as to their fitness for work;
ii. their racial or ethnic origin or religious or similar beliefs to monitor compliance with equal opportunities legislation; and
iii. information relating to any criminal proceedings in which they have been involved for insurance purposes and to comply with legal requirements and obligations to third parties.
1.3 In order to protect the confidentiality of Bespoke and the Client, the Tutor agrees not at any time whether during or after an Assignment (unless expressly so authorised by the Client or Bespoke Tuition as a necessary part of the performance of their duties), to disclose to any person or to make use of any Confidential Information of the Client or Bespoke unless required by law.
1.4 At the end of each Assignment or on request the Tutor agrees to deliver up to the Client or Bespoke (as directed) all documents (including copies) or materials belonging to the Client which are in its possession, including any data stored on the Client’s computer systems or other electronic equipment.
1.5 Bespoke collects information from Clients and Tutors when they choose to participate in Bespoke Tuition’s offers and services; subscribe; call or email us; or otherwise provide information directly with us in the form of;
i. Name;
ii. Email;
iii. Postal address;
iv. Demographic information;
v. Payment information;
vi. Communication preferences; and
vii. Education preferences and history
1.6 The information Bespoke collects from Clients and Tutors is used to inform them of Bespoke’s products, events and services; create and manage their account; send emails with personalised information and process payment for purchases or services.
1.7 Bespoke keeps in touch with Clients and Tutors via newsletter campaigns which inform subscribers about updates and services provided by the agency. All personal data relating to subscribers is held securely and in accordance with the EU General Data Protection Regulation (GDPR) 2018.
1.8 In accordance with UK Spam Laws and the Privacy and Electronic Communications Regulations 2003, subscribers can un-subscribe at any time through a process detailed at the footer of each email campaign.
1.9 Clients and Tutors have the right to access the personal information that Bespoke holds about them (as defined in the EU General Protection Data Regulation 2018) upon receipt of a written request. Before providing personal information to Clients and Tutors, proof of identity will be requested to enable the agency to locate the personal information. If any of the personal information held is inaccurate or out of date, Clients and Tutors may ask Bespoke to correct it.
1.10 Clients and Tutors have the right to object to Bespoke processing their personal information if Bespoke is not entitled to use it any more, to have their information deleted if Bespoke is keeping it too long or has its processing restricted in certain circumstances. If Clients and Tutors would like to exercise this right, they must contact Bespoke Tuition.
